In a four separate decisions on January 2013, an NCR Labor Arbiter ruled in favor of the security guards against the Maxim Security Agency, Lambdan Security Agency, 3rdAlert Security and Detective Services, Inc. and Armijoy Security Agency.
The claims of the security guards are illegal dismissal, non-payment and underpayment of salary and 13thmonth pay, overtime pay, holiday pay, holiday premium pay, rest day premium, ECOLA, night shift differentials, refund of cash bond, illegal deduction, among others.
The total monetary claims awarded by the Labor Arbiter to each of the security guards amounted to P51,969.56, P98,690.93, P134,190.00 and P46,772.40, respectively.
“This Arbitration finds and so hold that complainants were indeed not paid their correct mandated benefits,” the Labor Arbiter said.
“In the absence of evidence to show that complainants were indeed paid their correct wages and other benefits, respondents should pay the same,” she added.
The Labor Arbiter has exclusive jurisdiction over illegal dismissal, money claims and other claims arising from employer-employee relationship, among others.
If no appeal is filed, the decision or order of the Labor Arbiter becomes final and executory after ten (10) calendar days from receipt thereof.
