New NLRC notice of decision/order/resolution template prescribed by NLRC chief

          In an Administrative Order No. 02-06, Series of 2013, a revised NLRC Notice of Decision/Order/Resolution template was prescribed by Chairman Gerardo C. Nograles, upon consultation with the Commission En Banc, to all Executive/Labor Arbiters at the Regional Arbitration Branches.

          The new Notice of Decision/Order/Resolution template was issued to ensure uniformity in the issuance thereof and to apprise workers/employees of the requisites for perfecting an appeal.

          Under the new template, the date of the decision/order/resolution was included, with notice that the decision, award or order of the Labor Arbiter is final and executory unless appealed to the Commission by any or both parties within ten (10) calendar days from receipt thereof, pursuant to the Labor Code, as amended.

          It is also included in the notice that in case of reinstatement, the decision of the Labor Arbiter insofar as the reinstatement aspect is concerned, will be immediately executory, even pending appeal, and the employee will, either be admitted back to work under the same terms and conditions in the payroll.

         To effectively monitor the compliance of the employer, there is a notice also that the employer is likewise directed to submit a report of compliance within ten (10) calendar days from receipt of the decision or order. And no motion for reconsideration of this decision/order/resolution will be entertained.

          The posting of a bond by the employer will not stay the execution for reinstatement.

          In order to expedite the processing of filing an appeal, all the requisites/requirements for perfection of an appeal was enumerated in the notice of the decision/order/resolution.

          There was also a reminder in the notice that due to the proliferation of fake surety bonds, appellants are sternly advised to deal only with authorized agents of accredited surety companies, and exercise due and utmost diligence to ensure that the surety bond posted is genuine. The posting of a fake or irregular bond will result in the outright dismissal of the appeal.

          The simplified but comprehensive notice of decision/order/resolution template was part of the administrative intervention of the NLRC in reforming its labor adjudication and arbitration.
